Personal Graphics operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Personal Graphics is powered by Shopify, which enables us to provide the Services to you. 
The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.

By opting in to receive SMS messages from Personal Graphics, you agree to receive text messages related to inquires, quotes, order updates, customer support, and account notifications.

Message frequency may vary based on your interactions with us.

Message and data rates may apply depending on your mobile carrier and plan.

You may opt out of receiving SMS messages at any time by replying STOP to any message. After sending STOP, you will no longer receive SMS messages from us.

If we are unable to accept, modify, or fulfill an order, we will make reasonable efforts to notify you using the contact information provided at the time of purchase.

Shipping and delivery dates provided through the Services are estimates only and are not guaranteed. Personal Graphics is not responsible for delays caused by shipping carriers, customs processing, incorrect delivery information, or events outside our reasonable control.

Once an order has been transferred to the shipping carrier, title to and risk of loss for the products pass to you. Any claims for lost, delayed, or damaged shipments must be directed to the carrier, unless otherwise required by applicable law.

Shopify’s name, logos, and related branding are trademarks of Shopify. All other trademarks appearing on the Services are the property of their respective owners.

The Services may provide access to tools, features, or resources offered by third parties. Personal Graphics does not control, monitor, or manage these third-party tools and provides access to them solely for convenience.

Personal Graphics operates its Services using Shopify’s platform, which enables us to provide our online store and related functionality. However, all sales, purchases, and transactions made through the Services are entered into directly between you and Personal Graphics.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of transactions conducted through our store, including product quality, fulfillment, customer service, returns, refunds, or any injury, damage, or loss resulting from products or services purchased from Personal Graphics.

You expressly release Shopify and its affiliates from any and all claims, damages, losses, or liabilities arising from or related to your transactions with Personal Graphics.

Personal Graphics reserves the right, but has no obligation, to monitor, review, edit, or remove Feedback that we determine, in our sole discretion, violates these Terms, infringes upon third-party rights, or is unlawful, offensive, misleading, or otherwise objectionable.

You agree that your Feedback will not infringe upon the intellectual property, privacy, publicity, or other rights of any third party, will not contain unlawful, defamatory, abusive, or obscene material, and will not include viruses or other malicious code. You are solely responsible for the content and accuracy of any Feedback you submit, and Personal Graphics assumes no liability for Feedback provided by you or any third party.

  • upload, transmit, or distribute viruses, malware, or other malicious code;

  • collect, track, or harvest personal information of others without consent;

  • engage in scraping, crawling, phishing, or similar data-collection activities; or

Personal Graphics reserves the right to suspend, restrict, or terminate your access to the Services, with or without notice, if we determine that you have violated these Terms or engaged in prohibited conduct.

This limitation applies to any claim arising out of or relating to your access to or use of the Services, any products or services purchased through the Services, or any content made available through the Services, whether based in contract, tort (including negligence), strict liability, or any other legal theory, even if advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of liability for certain damages, so portions of this section may not apply to you. In such cases, liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Personal Graphics, Shopify, and their respective owners, affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any claims, losses, damages, liabilities, and expenses, including reasonable attorneys’ fees, arising out of or related to:

(a) your breach of these Terms or any policies incorporated by reference;

(b) your violation of any applicable law or the rights of a third party; or

(c) your access to or use of the Services.

Personal Graphics will provide notice of any claim subject to indemnification, provided that failure to give prompt notice will not relieve you of your obligations unless you are materially prejudiced by such failure. We reserve the right to assume control of the defense and settlement of any indemnified claim at your expense, including selection of counsel. We will not settle any claim that imposes non-monetary obligations on you without your prior consent, which shall not be unreasonably withheld.

You agree to cooperate fully in the defense of any indemnified claim, including by providing information and documents reasonably requested.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall be enforced to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. The validity and enforceability of the remaining provisions shall not be affected.

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

These Terms, together with any policies or rules referenced herein or posted in connection with the Services, constitute the entire agreement between you and Personal Graphics regarding your access to and use of the Services and supersede all prior or contemporaneous agreements, communications, or understandings, whether written or oral.

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

You may not assign, transfer, or delegate these Terms or any of your rights or obligations under these Terms without the prior written consent of Personal Graphics, and any attempted assignment in violation of this section will be null and void.

Personal Graphics may assign, transfer, or delegate these Terms and its rights and obligations at any time without notice or consent, including in connection with a merger, sale of assets, or other business transaction.

These Terms, and any separate agreements through which we provide the Services, shall be governed by and construed in accordance with the laws of the state or territory in which Personal Graphics is headquartered, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located within that jurisdiction, and you consent to the personal jurisdiction and venue of such courts.

Headings used in these Terms are for convenience only and do not limit, interpret, or otherwise affect the meaning or scope of any provision.

Where required by applicable law, we will provide notice of material changes, and such changes will become effective on the date specified in the notice. Your continued access to or use of the Services after changes become effective constitutes acceptance of the updated Terms.
